The Central Board of Direct Taxes (‘Board’) has issued a report proposing for amendment to the Rules on profit attribution to permanent establishments (‘PE’) of foreign enterprises in India. A committee was appointed by the CBDT to bring clarity and certainty in the rules governing attribution of profits to PE. The committee vide this report has made recommendations based on an examination of the existing scheme, the international best practices and their evolution over time, the views held by experts worldwide and an elaborate analysis of how economies (including digital economies) contribute to business profits of multinationals.
